Welcome to Farmy (“Farmy”, “we”, “our”, or “us”).

These Terms of Service (“Terms”) govern your access to and use of Farmy's services, including our WhatsApp assistant, website, mobile applications, and any related services (collectively, the “Services”).

By accessing or using Farmy, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use our Services.

You must have the legal capacity to enter into a binding agreement under the laws applicable to you in order to use Farmy.

If you are using Farmy on behalf of a business, cooperative, organization, or other entity, you confirm that you have the authority to accept these Terms on its behalf.

Farmy provides digital tools designed to help users manage farming activities and access agricultural information.

Depending on the services available, Farmy may allow you to:

Farmy may modify, improve, suspend, or discontinue any part of the Services at any time.

You are responsible for:

• Maintaining the confidentiality of any authentication credentials or verification codes.
• Ensuring that information you submit does not infringe the rights of others.
• Using Farmy in accordance with these Terms and applicable laws.

You remain responsible for all activities carried out using your account.

You agree not to use Farmy to:

• Upload or distribute unlawful, harmful, fraudulent, or misleading content.
• Attempt to gain unauthorized access to Farmy, other user accounts, or related systems.
• Interfere with or disrupt the operation or security of the Services.

• Misuse, abuse, or attempt to exploit vulnerabilities within the Services.
• Use Farmy in a manner that infringes the rights or privacy of others.

We reserve the right to suspend or terminate accounts that violate these Terms.

Farmy may provide information, reminders, insights, forecasts, analyses, or recommendations using automated technologies.

While we aim to provide useful and reliable information, Farmy's outputs are provided for general informational purposes only.

They should not be relied upon as a substitute for professional advice, including agricultural, veterinary, financial, legal, or other specialist advice where appropriate.

You are responsible for evaluating any information provided by Farmy before making decisions based on it.

We strive to provide reliable Services but do not guarantee uninterrupted or error-free operation.

Access to Farmy may occasionally be affected by:

• Maintenance or system updates.
• Network or connectivity issues.
• Third-party service interruptions.

• Circumstances beyond our reasonable control.

We may temporarily suspend or restrict access where necessary to maintain the security, stability, or integrity of the Services.

To the fullest extent permitted by applicable law, Farmy is provided on an “as is” and “as available” basis.

We do not guarantee that the Services will always be accurate, complete, uninterrupted, secure, or free from errors.

To the maximum extent permitted by law, Farmy shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, revenue, business opportunities, data, or production, arising from or related to the use of the Services.

Nothing in these Terms excludes liability where such exclusion is not permitted by applicable law.

We may suspend or terminate access to Farmy if:

• You violate these Terms.
• Your use of the Services creates legal or security risks.
• We are required to do so by law.
• We discontinue the Services.

You may stop using Farmy at any time.

Termination does not affect any rights or obligations that arose before termination.

Updated Terms will become effective when published unless otherwise stated.

Any disputes arising from or relating to these Terms or the Services shall be subject to the jurisdiction of the competent courts of Kenya, unless applicable law provides otherwise.
